Harris-Biden are doubling down on their efforts to destroy women’s sports. How? By overhauling Title IX to gut the very protections the law was designed to protect. It’s destructive, dangerous, and downright delusional.

As students head back to school, it’s also time to head back to reality. Boys play on boys teams. And girls play on girls teams. Civil rights attorney Candice Jackson sat down with Outspoken to discuss the history of Title IX and what’s at stake in this election.

0:21 much time debating questions that were

0:23 totally obvious just a few years ago and

0:26 questions with answers that are still

0:28 obvious to the overwhelming majority of

0:30 Americans how did a lunatic fringe set

0:33 of beliefs take over the mainstream and

0:36 gain so much political Capital inside

0:38 Washington and more importantly what are

0:40 the real world effects of this madness

0:44 well at the center of that conversation

0:45 is a landmark civil rights law called

0:47 Title 9 my name is Candace Jackson I’m

0:50 an attorney I’m a mom I worked in the

0:53 Trump education department and I’m on

0:55 the front lines in the fight to save

0:57 women’s sports save our schools save

1:00 America’s sanity in 1972 Congress passed

1:04 a civil rights law called Title 9 the

1:06 purpose of the law was to ensure that no

1:09 person would be excluded from

1:10 educational programs or activities on

1:12 the basis of sex over the years you’ve

1:14 probably heard about Title 9 most in the

1:17 context of of college sports where some

1:19 colleges were were forced to add or

1:21 eliminate certain programs to make sure

1:23 there was an equitable distribution of

1:25 resources between men’s and women’s

1:27 athletic teams so for example Title 9

1:29 required s that female and male student

1:31 athletes uh receive athletic scholarship

1:34 dollars proportionate to their

1:36 participation and that resources be

1:38 divided in a fair Manner and while

1:40 implementation has caused some

1:41 controversy over the years there’s no

1:43 doubt that title 9 has helped level the

1:46 playing field for female athletes over

1:48 the last 50 years always with the

1:50 understanding that a girls team is for

1:52 girls Title 9 doesn’t just apply to

1:55 sports though the law applies to every

1:57 aspect of K through 12 and higher

1:59 education

2:00 including course offerings counseling

2:02 Health Services access to campus

2:05 facilities and so here’s where it gets

2:07 interesting the title 9 statute

2:09 prohibits discrimination based on sex

2:12 but doesn’t actually Define sex because

2:14 it was so obvious decades ago Congress

2:16 didn’t even find it necessary to Define

2:19 in a law that humans are immutably male

2:23 or female until now when the Biden

2:26 Harris Administration is exploiting that

2:28 lack of definition as part of their

2:30 Title 9 rewrite expanding sex

2:33 discrimination to include gender

2:35 identity what’s this mean well it can

2:39 mean whatever you want it to mean

2:40 because the very concept of gender

2:42 identity amounts to everyone getting to

2:45 choose what sex they are and everyone

2:47 else being forced to pretend to believe

2:49 it any student can Proclaim their sex

2:52 being anything they want male female

2:55 both neither and take advantage of any

2:57 benefits that come with that declaration

2:59 so so for example a biological male

3:01 claiming to be a woman would be able to

3:03 access women’s restrooms locker rooms

3:06 play on girls sports teams uh take a a

3:09 scholarship dedicated to to a female

3:11 athlete even demand so-called preferred

3:14 pronouns be used for them and the Biden

3:17 Harris Title 9 framework would be

3:19 standing in their Corner ready to

3:21 enforce those whims so remember schools

3:23 receiving Federal funding would have to

3:25 adhere to these new education department

3:28 guidelines or risk serious consequences

3:30 even if your local school district or or

3:34 State College wanted to stand up to the

3:36 insanity and classify students as male

3:38 or female based on reality and and

3:41 biology those schools will be risking

3:43 not just losing federal dollars but also

3:46 being piled on with investigations

3:49 audits Court battles and and negative

3:52 press for 50 years Title 9 has been

3:55 committed to ending sex-based

3:57 discrimination but now the woke left

4:00 wants to overhaul the whole purpose of

4:01 the law to fulfill more of their

4:03 far-left postmodern Marxist fantasies

4:07 Title 9 once seen as a high water mark

4:10 for women’s rights and goals of equality

4:12 between the Sexes is now being turned

4:15 upside down by the same bureaucrats and

4:17 activists who just 5 minutes ago would

4:19 lecture us about the need to protect

4:21 women’s rights if you’re thinking to

4:23 yourself This doesn’t make any sense

4:25 you’re right and you’re not alone it

4:28 makes no sense on the merits these

4:31 far-left bureaucrats are operating

4:33 through fear and force threatening

4:35 careers Grant dollars and uh Public

4:39 Image and reputations against anyone who

4:41 dares to call out this craziness and

4:43 while the leftwing mob wants you to

4:45 believe that this is about equal rights

4:47 of some kind the reality is exactly the

4:50 opposite the proponents of overhauling

4:53 title n this way actually want to

4:55 takeway rights from young women and

4:56 girls by denying them a fair playing

4:59 field and Sports denying them basic

5:01 safety and privacy measures in short by

5:05 denying that girls and women even exist

5:07 as a category distinct from boys and men

5:10 now the good news is Republican attorney

5:11 generals are fighting back right now

5:13 making their cases in court 26 states

5:16 have filed suit against the Biden Harris

5:18 Title 9 overhaul they’re arguing that

5:21 the education department is operating

5:23 outside of statutory Authority in a way

5:25 that’s arbitrary and capricious in

5:27 violation of the administrative

5:29 procedure act and in violation of the

5:32 Constitution whether it’s the spending

5:34 Clause the First Amendment 5th 10th 14th

5:37 amendments and most importantly they

5:39 arguing that the Biden Harris rule would

5:41 gut the very protections that this law

5:43 was enacted to protect earlier this

5:46 summer injunctions were issued in

5:48 federal courts stopping these new

5:50 radical rules from going into effect for

5:52 now and back in the middle of August the

5:55 Supreme Court in a 5 to4 decision voted

5:57 to reject a Biden Harris admin

5:59 Administration emergency request to let

6:02 them enforce portions of the of the

6:04 title 9 rule that relate to gender

6:06 identity so while the Department of

6:08 Education is busy focusing on this

6:10 bizarre obsession with coddling

6:12 biological men and boys who who want to

6:14 identify as girls it shows no concern

6:17 for the women and girls who are forced

6:19 to suffer the consequences and it’s all

6:22 in direct Defiance of five Decades of

6:25 progress made by women and girls as a

6:27 result of Title 9 discrimination

6:29 protections so where do we go from here

6:32 well first off with a republican

6:34 majority in Congress lawmakers need to

6:36 make it a top priority to update Title 9

6:39 to Define sex and recognize that girls

6:42 and women need and deserve female only

6:45 spaces this can stop future executive

6:48 branches from trying these dirty tricks

6:49 all over again and furthermore with the

6:51 Supreme Court’s recent decision

6:53 overturning so-called Chevron Defrence

6:56 these regulations can be scrapped

6:58 immediately when the full case is heard

6:59 on the merits so look there’s a lot

7:02 we’ve covered because there’s a lot at

7:04 stake when you hear about gender

7:07 identity it’s about the factually false

7:10 belief that humans can choose and change

7:13 their sex it’s about denying basic

7:16 reality and it’s girls and women who

7:19 suffer most when Society pretends to

7:21 believe these lies and don’t fall for

7:24 the woke left’s tactic of accusing

7:26 anyone who rejects the false notion of

7:28 gender identity as being anti-gay in

7:31 fact belief in gender identity is itself

7:34 very anti-gay and I say that as a

7:36 lesbian horrified to witness this gender

7:38 identity craze trying to deny people’s

7:41 sexual orientation so remember at its

7:45 core this is about calling a boy a boy

7:48 and a girl a girl it’s about saying out

7:50 loud what’s always been true and obvious

7:53 and doing it unapologetically and

7:56 unafraid so if you care about your kids

7:58 if you care about your schools if you

8:01 want to restore common sense and simple

8:03 reality into our laws and policies then
